Automatic Updates: Most updates happen automatically on our end without requiring any action from you. The Bot will simply start using the new features or fixes the next time it's run. You don't need to reinstall or reconfigure anything.
Breaking Changes: If an update significantly changes how a feature works or removes functionality, we'll provide advance notice whenever possible so you can prepare and adjust your server's setup if needed.
7. Account Termination and Data
You have the right to stop using the Bot at any time, for any reason, without penalty or explanation required.
How to Stop Using the Bot: Simply remove the Bot from your Discord server(s) or stop using its commands. There's no formal "cancellation" process needed because the service is free and doesn't involve subscriptions or accounts.
Automatic Data Deletion: When you stop using the Bot, we respect your decision to leave and don't hold onto your data indefinitely. Here's what happens:
- When you remove the Bot from your server, we automatically detect this and begin the data deletion process
- Your data will be automatically deleted from our systems within 30 days of the Bot being removed
- This 30-day window exists to account for temporary removals (in case you change your mind) and to ensure complete data cleanup across all systems
- After 30 days, your server's data and associated user information are permanently deleted
Immediate Deletion: If you want your data deleted immediately rather than waiting 30 days, you can submit a data deletion request as described in the Privacy Policy (Section 7). We'll process manual deletion requests much faster, typically within 7 business days.
We May Terminate Access: We reserve the right to terminate or suspend your access to the Bot if you violate these Terms, engage in prohibited activities, or if we receive legal requests requiring us to do so. If we terminate your access, we'll inform you of the reason unless prohibited by law.
Server Deletion: If a Discord server is deleted (not just the Bot removed, but the entire server deleted), associated data is automatically purged from our systems immediately as we detect that the server no longer exists.
8. Intellectual Property
The Bot, including all of its code, design, features, documentation, and related materials, is the intellectual property of Capitanfunny and is protected by copyright and other intellectual property laws.
What This Means:
- Ownership: Capitanfunny claims full and exclusive ownership of the Bot's source code, design, logic, algorithms, and all related materials. This includes both the parts you can see (the commands and responses) and the parts you can't see (the underlying code and infrastructure).
- Copyright Protection: The Bot is protected by copyright law. This means you cannot copy, reproduce, distribute, or create derivative works based on the Bot without explicit written permission.
- Trademarks: The Bot's name, logo, and other identifying marks are the property of Capitanfunny. You may not use these marks in a way that suggests endorsement or affiliation without permission.
What You Can Do: You are granted a limited, non-exclusive, non-transferable license to use the Bot for its intended purpose (moderating and enhancing your Discord server). This license is personal to you and cannot be transferred or sold to others.
What You Cannot Do:
- Copy or replicate the Bot's code or functionality
- Sell, rent, lease, or sublicense access to the Bot
- Remove or modify any copyright notices or attribution
- Reverse engineer the Bot to create competing services
- Claim the Bot or any of its features as your own work
User-Generated Content: While we own the Bot, you retain ownership of any content you create or input through the Bot (like moderation case notes). However, by using the Bot, you grant us the right to process and store that content as necessary to provide the service.
Respecting Others' IP: You must also respect the intellectual property rights of others when using the Bot. Don't use the Bot to infringe on copyrights, trademarks, or other protected rights.
9. Disclaimers and Limitations
This section contains important legal protections that you need to understand. While we work hard to provide a reliable service, we need to be clear about what we can and cannot guarantee.
9.1 "As-Is" Service
The Bot is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.
What This Means: We're providing the Bot in its current state, with all its current features and any current limitations or bugs. We don't make promises about:
- The Bot being error-free or uninterrupted
- All features working perfectly 100% of the time
- The Bot meeting your specific needs or expectations
- The results you'll get from using the Bot
9.2 No Warranties
To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:
- Merchantability: We don't warrant that the Bot is suitable for commercial use or sale
- Fitness for a Particular Purpose: We don't guarantee the Bot will meet your specific needs
- Non-Infringement: While we own our code, we don't warrant that the Bot's operation will not infringe any third-party rights
- Accuracy: We don't warrant that information provided by the Bot is always accurate or up-to-date
9.3 Limitation of Liability
To the fullest extent permitted by law, Capitanfunny shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Bot
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Bot
- Any bugs, viruses, or other harmful code that may be transmitted to or through the Bot
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Bot
9.4 Your Responsibility
You understand and agree that:
- You use the Bot at your own risk
- You are responsible for maintaining appropriate backups of your data
- You should not rely solely on the Bot for critical moderation needs
- We recommend having backup moderation methods in case of Bot downtime
9.5 Realistic Expectations
While we strive for excellent reliability and performance, we're honest about what to expect: The Bot is a free service run by an individual developer, not a large corporation. We do our absolute best to keep things running smoothly, fix issues quickly, and continuously improve the Bot. However, occasional downtime, bugs, or unexpected behavior may occur. We appreciate your understanding and patience when issues arise.
10. Governing Law
These Terms of Service, and any disputes arising from or relating to them or your use of the Bot, are governed by and construed in accordance with the laws of the State of Colorado, United States of America, without regard to its conflict of law provisions.
10.1 What This Means
Applicable Law: If there's ever a legal dispute about these Terms or the Bot, Colorado law will be used to interpret the Terms and resolve the dispute. This provides consistency and predictability regardless of where you're located.
Why Colorado: The Bot is operated from Colorado, and this is where Capitanfunny is based, so it makes sense for Colorado law to apply.
10.2 Dispute Resolution
Informal Resolution First: If you have a dispute or concern, please contact us first. Most issues can be resolved through friendly communication without legal action. We're committed to working with you to find fair solutions.
Jurisdiction and Venue: If informal resolution doesn't work and legal action becomes necessary, you agree that any legal proceedings will take place in the appropriate courts located in Colorado. This means both parties consent to the jurisdiction of Colorado courts.
10.3 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of law, that provision will be limited or eliminated to the minimum extent necessary so that the rest of these Terms remain in full force and effect.
What This Means: If one part of these Terms is found to be legally invalid, the rest of the Terms still apply. We won't throw out the entire agreement just because one clause doesn't work.
10.4 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Capitanfunny regarding the Bot. They supersede any prior agreements, understandings, or representations, whether written or oral.
What This Means: These Terms and the Privacy Policy are the complete and final statement of our agreement. Any previous conversations, promises, or agreements about the Bot are replaced by these documents.
10.5 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Even if we don't immediately act on a violation, we still retain the right to enforce these Terms later.
